A diver at the surface is almost invisible from a boat, and a surface marker buoy is the difference between being seen and being run over.

Boat traffic and being seen — Can cause serious injury or death
A diver at or near the surface is struck by a vessel whose operator never saw them. The diver's head is a small, low, dark object that is effectively invisible from a moving boat.
What reduces it: Tow a surface marker buoy that stays over the diver, ascend with a hand raised while looking up, use high-visibility equipment, and avoid diving in channels, harbour approaches and transit routes.
A spearfisher's head is a small dark object a few centimetres above the water, often in chop, frequently against a background of rock or glare. From a boat at planing speed, it is effectively invisible until far too late.
That asymmetry is the whole problem. The diver can see and hear the boat; the boat cannot see the diver. Boat strike is a leading cause of serious injury and death in spearfishing, and it happens in exactly the shallow inshore water where both activities concentrate.
A surface marker buoy, towed by the diver, changes the geometry: it is larger, coloured, sits higher, and moves in a way that is recognisable. In many places it also carries a dive flag whose meaning is defined in local rules.
What a buoy does and does not do
It makes a diver visible and it gives them something buoyant to hold. Both matter, and the second is regularly the more useful on a long swim or in current.
What it does not do is confer right of way, guarantee that anybody is looking, or protect a diver who surfaces well away from it. A buoy left at the entry point while the diver works two hundred metres down the reef is protecting the wrong piece of water.
The practical requirement is that the buoy stays with the diver — towed on a line long enough to be comfortable and short enough to stay overhead — and that the diver surfaces looking up and listening before ascending the last few metres.
Dive flags exist in several designs with different legal standing in different countries, and what they require of nearby vessels varies. FishingHQ does not state what any of those requirements are.

Surfacing where a boat might be
Ascending with one hand raised and turning to look up during the last few metres is standard practice for exactly this reason, and it is worth doing even where no engine can be heard — sound underwater gives poor directional information, and a boat can be much closer than it seems.
High-risk situations are predictable: harbour approaches, channels, moorings, popular anchorages and any water where boats transit at speed. Diving those areas at all is a decision that deserves more scrutiny than the reef itself gets.
Bright equipment helps at the margin. A high-visibility buoy, a bright fin tip and a coloured hood are all cheap and all improve the chance of being seen at the moment it matters.
